1. Acceptance of Terms and Binding Contract

PLEASE READ THESE TERMS OF SERVICE ("TERMS" OR "AGREEMENT") CAREFULLY BEFORE ACCESSING OR USING VOYSD. THIS AGREEMENT CONSTITUTES A LEGAL, BINDING CONTRACT BETWEEN YOU ("USER", "YOU", OR "YOUR") AND XELDUST.

BY CLICKING "CONTINUE WITH GOOGLE", CHECKING THE MANDATORY LEGAL CONSENT BOX, CREATING AN ACCOUNT, OR ACCESSING OR USING ANY PORTION OF THE VOYSD WEB APPLICATION AT HTTPS://VOYSD.XELDUST.COM/, PLATFORM, OR SERVICES, YOU EXPLICITLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN, AS WELL AS OUR PRIVACY POLICY AND COOKIE POLICY.

IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU ARE STRICTLY PROHIBITED FROM ACCESSING OR USING VOYSD AND MUST IMMEDIATELY DISCONTINUE ALL USE OF THE SERVICE.

2. Eligibility and Strict Age Policy (16+ Mandate)

A. Baseline Age Requirement: Voysd is intended solely for users who are sixteen (16) years of age or older. By creating an account or using the Service, you represent and warrant that you are at least sixteen (16) years of age at the time of registration, possess the legal capacity and authority to enter into a binding contract, and are not prohibited from using the Service under applicable laws.

B. Prohibition of Use Under 16: ANY PERSON UNDER THE AGE OF SIXTEEN (16) IS STRICTLY PROHIBITED FROM REGISTERING AN ACCOUNT, ACCESSING, OR USING VOYSD. If XelDust discovers or has reason to believe that a user is under sixteen years of age, XelDust reserves the right to immediately terminate the user's account, delete their profile handle from the public directory, and block their access to the Service without prior notice or liability.

C. Age-Gated Media Link Restrictions (Under 18): Users who are between sixteen (16) and seventeen (17) years of age are permitted to use the messaging and story features of the platform; however, their account settings permanently restrict media link embedding and external player previews ("Allow Links & Previews" forced OFF). Only users who are eighteen (18) years of age or older may enable link previews and video embeds.

3. Account Registration, Google Authentication, and Security

A. Google OAuth Authentication: To mitigate automated spam, directory scraping, bot account creation, and service abuse, Voysd requires account authentication strictly via Google Sign-In (Google OAuth 2.0). You agree that you are solely responsible for maintaining the security and confidentiality of your Google account credentials.

B. Profile Handles and Visibility: You must select a unique, lowercase username handle (@username) governed by our formatting rules (3–20 characters; lowercase letters a-z, numbers 0-9, underscores _, and hyphens -). You may configure your profile as Public (searchable in our directory) or Private (unlisted, accessible solely via direct invitation links). Handles are registered on a first-come, first-served basis. XelDust reserves the absolute right to reclaim, suspend, modify, or terminate any handle that infringes third-party trademarks, contains hate speech, impersonates another person or entity, or violates these Terms.

C. Account Responsibility: You are entirely responsible for all activities, transmissions, content postings, and peer-to-peer connections established under your account. XelDust assumes zero liability for any loss, damage, or compromise resulting from unauthorized access to your Google account or client device.

4. Decentralized P2P Architecture & Zero-Knowledge Disclaimer

You explicitly understand and acknowledge the technical nature of Voysd's peer-to-peer (P2P) architecture:

  • No Central Message Storage: Messages, voice calls, video feeds, and file transfers are encrypted locally on client devices via WebCrypto (ECDH and AES-GCM-256) and transmitted directly between peer devices over WebRTC data channels.
  • Zero Company Decryption Capabilities: XelDust does not monitor, inspect, moderate, store, or back up decrypted peer-to-peer communications.
  • Local Device Storage Responsibility: All conversation histories, avatars, and session keys reside locally within your browser's storage (IndexedDB). If you clear your browser data, uninstall your browser, or lose your client device, your local chat history and cryptographic keys are permanently lost. XelDust cannot recover lost local chat histories, media files, or encryption keys.

5. Acceptable Use Policy and Prohibited Conduct

You agree that you will use Voysd strictly in compliance with all applicable local, state, federal, and international laws and regulations. You explicitly agree NOT to engage in any of the following prohibited conduct:

  • Illegal Activity: Transmitting, sharing, or promoting any content, media, or message that violates applicable criminal or civil laws of the United States or any other applicable jurisdiction.
  • Child Sexual Abuse Material (CSAM): Generating, transmitting, requesting, or distributing Child Sexual Abuse Material, child exploitation content, or any material that harms or exploits minors. Any violation will result in immediate permanent account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and law enforcement agencies.
  • Harassment, Abuse, and Hate Speech: Engaging in severe harassment, stalking, bullying, intimidation, threats of violence, or promoting discrimination or hatred based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or medical condition.
  • Automated Scraping and Bot Attacks: Utilizing automated scripts, bots, spiders, crawlers, or unauthorized software to scrape profile directories, flood database signaling queues (/requests/), or execute Denial of Service (DoS/DDoS) attacks against our infrastructure.
  • Impersonation and Fraud: Impersonating any person, business, organization, or government entity, or falsely stating or misrepresenting your affiliation with any person or entity.
  • Malware and Exploits: Transmitting or uploading viruses, trojans, worms, logic bombs, corrupted files, or any malicious code designed to compromise client devices or WebRTC data channels.
  • Bypassing Access Controls: Attempting to bypass, disable, reverse-engineer, decompile, or tamper with age-verification gates, client-side moderation filters (TxtFilter), rate-limiting mechanisms, or database security rules.
  • Commercial Spam: Sending unsolicited commercial communications, promotional spam, chain letters, or pyramid schemes through Quick Msgs, Contact Stories, or signaling requests.

6. User-Generated Content & Section 230 Immunity Disclaimer

A. User Responsibility for Content: You acknowledge that all messages, text strings, URLs, video embeds, images, files, Contact Stories, and media shared or transmitted via Voysd ("User Content") are the sole responsibility of the person from whom such content originated. You represent and warrant that you own or possess all necessary rights, licenses, consents, and permissions to share your User Content.

B. Federal Statutory Immunity (Section 230 Notice): TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, XELDUST OPERATES AS AN INTERACTIVE COMPUTER SERVICE PROVIDER PURSUANT TO SECTION 230 OF THE UNITED STATES COMMUNICATIONS DECENCY ACT (47 U.S.C. § 230). XELDUST DOES NOT PUBLISH, EDIT, CONTROL, VERIFY, OR ASSUME EDITORIAL RESPONSIBILITY FOR USER CONTENT TRANSMITTED OVER DECENTRALIZED PEER-TO-PEER CHANNELS OR POSTED TO CONTACT STORIES. XELDUST SHALL NOT BE HELD CIVILLY OR CRIMINALLY LIABLE FOR ANY USER CONTENT, DEFAMATORY STATEMENTS, OBSCENITY, HARASSMENT, INFRINGEMENT, OR ILLEGAL CONDUCT ENGAGED IN BY USERS ON OR THROUGH THE SERVICE.

7. Contact Stories and Community Moderation

A. Ephemeral Post Rules: Public account users may post up to five (5) Contact Stories per 24-hour period, subject to a 280-character text limit. All stories automatically expire and self-destruct 24 hours after creation.

B. Embedded Video Media Rules: Stories may include oEmbed links to external video services (e.g., YouTube or Vimeo). Embedding is restricted strictly to adult accounts who have enabled media previews. XelDust does not host or store embedded video files. Video playback occurs via third-party iframe players subject to the terms and safety policies of those respective third-party video platforms.

C. Client Moderation and Community Reporting: Client-Side Filtering: Text entered into stories or messages passes through a client-side moderation script (TxtFilter) operating locally within your browser memory to screen for profanity and explicit patterns prior to submission. Community Report Threshold: Users can report violating Contact Stories via the in-app menu ("Report Story"). If a story accumulates three (3) community reports from separate accounts, its visibility is automatically masked across the platform. XelDust reserves the right to delete masked stories or terminate the handles of repeat policy violators.

8. DMCA and Copyright Infringement Takedown Policy

XelDust respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"). If you believe in good faith that your copyrighted work has been infringed or made accessible on Voysd in a manner that constitutes copyright infringement, please submit a written DMCA Takedown Notice to our Designated Copyright Agent at support@xeldust.com containing the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and info to locate the material (e.g. @username).
  • Info to contact you, such as address, phone number, and email.
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
  • A statement that the info in the notification is accurate and under penalty of perjury.

9. Intellectual Property Rights

The Voysd name, logo, brand assets, source code, web interface designs, Tailwind custom styling rules, custom icons, graphics, software architecture, and compilation of platform elements are the exclusive intellectual property of XelDust and its licensors. Subject to compliance with these Terms, XelDust grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Voysd web app for personal, non-commercial messaging. You shall not copy, modify, distribute, reverse-engineer, or decompile the software.

10. Third-Party Services and Infrastructure

Voysd relies on infrastructure services provided by Google (Google Firebase, Google OAuth, Firebase Realtime Database, Google Cloud Messaging) and Cloudflare (public STUN servers). Your use of the Service is also subject to the operational availability and terms of these third-party infrastructure providers. XelDust is not responsible or liable for service interruptions, data losses, push notification delivery failures, or outages caused by third-party infrastructure providers.

11. Absolute Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. XELDUST EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. XELDUST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PEER-TO-PEER DATA TRANSMISSIONS WILL PREVENT ALL POSSIBLE VULNERABILITIES.

12. Absolute Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL XELDUST, ITS OFFICERS, DIRECTORS, OR INFRASTRUCTURE SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, CHAT HISTORIES, OR CRYPTOGRAPHIC KEYS, ARISING OUT OF OR RELATING TO THE SERVICE. XELDUST'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT PAID BY YOU TO XELDUST ($0.00) OR ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

13. Indemnification

You agree to defend, indemnify, and hold harmless XelDust, its parent company, officers, directors, employees, and agents from and against any claims, damages, losses, costs, or fees arising out of your access to or use of the Service, your User Content, your violation of these Terms, or any misrepresentation made by you concerning your age or eligibility.

14. Binding Individual Arbitration and Class Action Waiver

A. Informal Dispute Resolution: Before initiating legal action, you agree to contact support@xeldust.com to resolve any dispute informally for at least thirty (30) days.

B. Binding Individual Arbitration: If unresolved, Disputes shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

C. Class Action Waiver: YOU AND XELDUST AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. Governing Law and Jurisdiction

These Terms, our Privacy Policy, Cookie Policy, and all Disputes arising out of or related to the Service shall be governed by, construed, and enforced in accordance with the internal laws of the United States and the State of Delaware, without giving effect to any choice of law or conflict of law principles.

16. Severability, Waiver, and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be limited to the minimum extent necessary, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and XelDust regarding Voysd.

17. Changes to Terms of Service

XelDust reserves the absolute right to revise, update, or modify these Terms at any time in its sole discretion. Any changes will become effective immediately upon posting. Your continued use of the Service constitutes acceptance of the updated terms.
